Criminal Proceedings

Criminal proceedings are determined by the Criminal Code (KZ-1), while the Criminal Procedure Act (ZKP) defines procedural rules which ensure that no one who is innocent is convicted.

A person charged with a criminal offence is considered innocent until proven guilty with a final judgement.

The purpose of criminal proceedings is to decide on the offenders guilt and the guilty offender is then imposed a sanction for the criminal offence.

Criminal proceedings are composed of several phases. Monitoring the stages the proceedings have reached is important as they lead to the different positions of the defendant, including the following steps in the proceedings.
